Tdap – Brachial Neuritis/Parsonage Turner Syndrome

Howie Law, PC is pleased to report the results of another successful vaccine injury case.  Howie Law, PC represented a 63 year old, retired firefighter who received a Tdap (Tetanus, Diphtheria, Acellular Pertussis) vaccination administered in the deltoid of his left shoulder.  Approximately a week after the vaccination, our client started to develop weakness in his left arm and shoulder.

Our client was subsequently diagnosed with brachial neuritis (aka Parsonage Turner Syndrome) which is inflammation of the brachial nerve complex, a common injury known to be caused by tetanus-containing vaccinations.

Thankfully, our client’s symptoms nearly completely resolved after approximately twelve months.  Howie Law, PC filed a claim on behalf of our client under the National Vaccine Injury Compensation Program, and we were able to obtain compensation for our client in the amount of $75,000.  As our fees and expenses are resolved separate from our client’s recovery, our client received the entire amount of $75,000.

Tdap – Brachial Neuritis

Howie Law, PC is pleased to report the results of another successful vaccine injury case.  Howie Law, PC represented a 32-year old female who received a Tdap (Tetanus, Diphtheria, Acellular Pertussis) vaccination administered in the deltoid of her right shoulder.

Approximately two weeks later, our client began to notice weakness in her right arm while she performed routine, everyday tasks.  Her right arm weakness began to interfere with her ability to perform simple tasks such as putting dishes in overhead cabinets or curling or washing her hair.  She also developed severe pain in her arm that would cause her arm to throb after any physical activity.  An EMG/NCS was performed, the results of which were abnormal.

Our client was subsequently diagnosed with brachial neuritis (aka Parsonage Turner Syndrome) which is inflammation of the brachial nerve complex, a common injury known to be caused by tetanus-containing vaccinations.  Howie Law, PC filed a claim on behalf of our client under the National Vaccine Injury Compensation Program, and we were able to obtain compensation for our client in the amount of $75,000.  As our fees and expenses are resolved separate from our client’s recovery, our client received the entire settlement amount of $85,000.

 

Dtap – Shoulder Injury Related to Vaccine Administration (SIRVA)

 

Howie Law, PC is pleased to report the results of another successful vaccine injury case.  The settlement obtained for our client was one of the largest SIRVA (shoulder injury related to vaccine administration) cases in the Vaccine Injury Program.  Howie Law, PC represented a 44-year old female registered nurse who received a Dtap (Diphtheria, Tetanus, Acellular Pertussis) vaccination administered in the deltoid of her left shoulder.  Immediately upon administration of the vaccination, our client felt pain in her shoulder, and over the course of the next week, the pain steadily worsened.

Our client was eventually evaluated by an orthopedic surgeon who diagnosed her condition as tendonitis and bursitis with a frozen shoulder probably caused by her vaccination.  As a result of her shoulder injury, our client was unable to work consecutive shifts at the hospital where she was employed.

As such, her employer changed her from a full-time with benefits employment position to a part-time without benefits employment position resulting in a considerable loss of income for our client.  Howie Law, PC filed a claim on behalf of our client under the National Vaccine Injury Compensation Program alleging that her Dtap vaccination caused her to suffer a SIRVA (Shoulder Injury Related to Vaccine Administration).

Influenza Vaccination – Shoulder Injury Related to Vaccine Administration

Soon, our client developed aching, sharp, and constant pain in her right shoulder which prevented her from sleeping on her right side or using her right arm for her daily activities such as driving, lifting a gallon of milk, or washing the dishes. Influenza Vaccination – Guillain-Barre Syndrome

Howie Law, PC is pleased to report the results of another successful vaccine injury case.  Howie Law, PC represented a 35-year old registered nurse who received an influenza vaccination.  Approximately three weeks after her influenza vaccination, our client began to have difficulty walking due to a feeling of heaviness and weakness in her legs.

Over the next few days, our client’s arms began to feel heavy, and our client began to develop problems lifting her arms over her head.  She also began to have problems walking.  Our client was evaluated in an emergency room where, after a number of tests were unremarkable, she was evaluated by a neurologist.  MRIs of her spine and brain were unremarkable; however, an EMG/NCS revealed widespread denervation of our client’s muscles throughout her body.  After a lumbar puncture, our client was diagnosed with Guillain-Barre Syndrome.

Unfortunately, our client had a very lengthy hospital and rehabilitation stay, and in spite of prolonged physical and occupational therapy, she was left with permanent deficits from her Guillain-Barre Syndrome.

Howie Law, PC worked with a number of experts on our client’s behalf in order to fully develop a fair and reasonable damage model to provide funds for our client for the remainder of her life.  The final resolution of the case included a lump sum payment of $1,294,629.62 which was comprised of lost earnings in the amount of $1,091.484.90, pain, suffering, and anguish in the amount of $150,000, and past, unreimbursed expenses in the amount of $14, 186.98.

The lump sum payment also included $38,957.74 which was for medical expenses our client would probably have to spend for her medical care during the first year after the case settled.  The settlement also included an annuity which will pay our client tens of thousands of dollars every year for her anticipated medical needs for the remainder of our client’s life.  As Howie Law, PC’s fees and expenses are resolved separate from our client’s recovery, our client received the entire settlement as detailed herein.
