Howie Law Settles Class Action Against Abusive Debt Collector

Howie Law, PC is pleased to announce the favorable conclusion of its class action lawsuit against Franklin Collection Service, Inc. for violations of the Fair Debt Collection Practices Act.  In that case, Howie Law, PC filed suit on behalf of its client, Scott Conrad, who received a letters from the debt collector, based in Mississippi, suggesting that it was going to file a lawsuit against Conrad over a $150.00 debt.

Recognizing that no Mississippi debt collector was going to come to Texas and sue over a $150.oo debt, Howie Law, PC filed suit asserting that Franklin Collection Service had violated the Fair Debt Collection Practices Act by threatening to take an action which it never intended to take.

Unfortunately, debt collectors will try anything to get a debt paid.  This includes even making a suggestion that it will file a lawsuit over a debt which is simply too small to justify a lawsuit.  Ultimately, a class of consumers was certified by the United States District Court, Northern District of Texas, and Franklin Collection Services paid to settle the case.
